Create two separate wills for this married couple . Make sure to use the correct form
Lisa and Christopher King have three children, Tessa, Brett and Samantha. They come to your office asking you to prepare a simple will for them, naming each other as beneficiaries of the other’s estate and their children equally as second to receive the estate. They are appointing Lisa’s brother, Joseph Mastropole as guardian and Lisa’s mother, Rose Mastropole as second guardian. They will each be each other’s executor, with Lisa’s brother, Joseph being second. Prepare a will with a life insurance trust provision naming Lisa’s brother as trustee, her mother, Rose as second trustee. The trust provision will be for the benefit of the children’s education and will include all of the proceeds of the life insurance policy as the corpus. The children will be able to receive the estate once they attain the age of 21. If there is any information you are missing that you feel is important, prepare a SHORT memo in addition to the will informing me of what is missing and why it is pertinent to this fact pattern.
